Levy County says Tarmac in compliance

In a recent letter to the Levy County Commission, County Attorney Anne Bast Brown concluded that Tarmac was in compliance with all County Special Exception Approvals regarding the test pit on the King Road Mine site. A complaint was filed last year claiming a condition was added to a special exception without the commission approval. The claimant said the condition allowed Tarmac to keep a test pit open on the King Road Mine site, instead of filling it back in. Anne Bast Brown dismissed the complaint, noting it did not merit any commission action and that Tarmac had fulfilled its obligations related to the test pit.

The special exception permit was approved in 2005 and allowed Tarmac to excavate a test pit to determine if there was suitable material (limestone) present to move forward with the King Road Mine project. The understanding was that Tarmac would refill the pit if the limestone was not suitable; or leave the pit open to be used once mining operations begin. The test pit revealed suitable limestone and is now part of the site plan.
